Terms of Service
1. Scope of these Terms
The Intl. Lung Cancer Summit (ILCS) and the website at lungsummit.org (the “Site”) are operated by PEAK Medicals GmbH, a Swiss limited liability company registered in Thalwil, Zurich. References in these Terms to “we”, “us”, or “our” mean PEAK Medicals GmbH.
These Terms govern your use of the Site and the services we provide through it, including video streaming, broadcasts, access to medical and editorial content, interactive tools, contests, downloads, and any other online service we operate (collectively, the “Services”). They form a legally binding agreement between you and us. If you do not agree to these Terms, you must not use the Site or register for the Services. The Privacy Policy and the Legal Notice form an integral part of these Terms.
PEAK Medicals GmbH also operates the OncoViews initiative (oncoviews.com). Where the same account grants access to both initiatives, these Terms govern your use of both.
2. Eligibility and intended audience
The Services are intended exclusively for “Healthcare Professionals” and equivalent industry stakeholders. For these purposes, a Healthcare Professional means a person who (i) is associated with a specialty or discipline that is qualified and permitted by an authorised regulatory body to provide a healthcare service within that specialty, and (ii) is practising professionally within that specialty in a hospital, clinic, research centre, university, government or regulatory body, or pharmaceutical or biotech company. Without limitation, this includes qualified medical doctors (general and specialist), oncology pharmacists, oncology nurses, clinical scientists, supportive-care professionals, academic researchers, and personnel of competent regulatory bodies such as the European Medicines Agency, Swissmedic, the United States Food and Drug Administration, or equivalent national authorities.
By using the Services, you confirm:
- that you are a Healthcare Professional as defined above, or an industry professional from a pharmaceutical or biotech company falling within the audience described above;
- that you are at least 18 years of age;
- that you have the legal authority to agree to these Terms, on your own behalf or on behalf of your organisation if you are using the Services in a professional capacity;
- that you are not prohibited by law, by regulatory order, or by professional regulation from accessing the Services or any of the content available through them; and
- that you will comply with these Terms, the Privacy Policy, and any applicable professional code of conduct.
We reserve the right to verify your eligibility at any time, to deny or revoke access where eligibility cannot be confirmed, and to require additional documentation. We make no representation or warranty as to the verified identity, qualifications, or licensing status of any user of the Services.
3. Permitted and prohibited conduct
You agree that you will not, in connection with your use of the Services:
- Use the Services to establish a physician-patient relationship, to diagnose, or to treat patients;
- Share your account credentials with any other person or allow any other person to use your account;
- Submit, upload, post, or transmit any personal data of a patient (including the patient’s name, initials, identifier number, image, voice, location, date of birth, or any combination of information that could reasonably identify the patient). You are solely responsible for ensuring that any case description, image, or clinical example you submit is fully de-identified in accordance with applicable medical-confidentiality law (including, as applicable, HIPAA, the GDPR, the Swiss FADP, PIPEDA, or PHIPA) and your professional duty of confidentiality;
- Submit content that infringes the rights of any third party, that is unlawful, defamatory, obscene, or harmful, or that contains personal data of a third party for whom you do not have a lawful basis to share;
- Disclose another user’s identity, contact details, or other personal information without their consent;
- Forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through the Services;
- Mirror, frame, scrape, or re-host the Site or any of its content, trademarks, or logos without our prior written consent;
- Remove or alter any copyright, trademark, or proprietary notice;
- Attempt to circumvent any technical protection measure or other safeguard associated with the Services, including any access-tier gating or geographic restriction;
- Use the Services or any content available through them to train any machine-learning model, generative-AI system, or other automated content-derivation system, except for non-commercial personal study by an individual Healthcare Professional;
- Use any data-mining tool, web crawler, or similar automated method to access the Site, except for search-engine indexing under a robots.txt-allowed path;
- Use the Services for any unlawful purpose or in a manner that breaches an applicable professional code of conduct.
4. Registration and access tiers
To access most of the Services you must register and complete the healthcare-professional verification process described in our Privacy Policy. Registration requires that you provide your full name, email address, profession, affiliation, and other information specified in the registration form (the “Registration Information”). You agree that your Registration Information is true, accurate, current, and complete, and that you will promptly update it as needed by notifying registration@lungsummit.org. Changes affecting Access Pass entitlements take effect within 48 hours of receipt. Misrepresentation of your professional status is a material breach of these Terms and entitles us to suspend or terminate your account without notice.
We currently offer four access tiers:
- Online Pass: free remote access for healthcare professionals and verified industry stakeholders
- Conference Badge: free on-site ILCS access for healthcare professionals and for professionals from sponsoring pharma and biotech companies
- Industry Pass: paid remote access for professionals from non-sponsoring pharma companies
- Industry Badge: paid on-site ILCS access for professionals from non-sponsoring pharma companies
Tier assignment is determined automatically from your registered email domain and your responses on the registration form. We reserve the right to verify, correct, or downgrade a tier where Registration Information is inaccurate, where sponsorship status changes, or where eligibility cannot be confirmed.
Paid tiers are processed by our card-payment processor. Prices are stated in Swiss francs or euros on the checkout page and include any applicable Swiss value-added tax. Paid tiers are charged on a one-off or annual basis as stated at checkout. You may cancel at any time from your account settings; cancellation takes effect at the end of the then-current paid period. We do not pro-rate refunds for partial periods. Statutory consumer-protection withdrawal rights, where they apply to you, are described at checkout and are not affected by these Terms.
5. Pharmaceutical sponsorship and editorial disclosure
The Site is multi-sponsored and supported through educational grants by pharmaceutical and biotech companies. This enables us to produce and distribute educational content widely; it does not control editorial judgement on independently produced content. Editorial content is developed independently of sponsorship and advertising. We disclose sponsorship transparently:
- Sponsored articles, videos, and sessions are labelled adjacent to the content, in line with the International Committee of Medical Journal Editors (ICMJE) Recommendations and equivalent industry guidance;
- Sponsor logos and sponsor microsites are clearly identifiable as sponsor properties;
- Where a faculty member has a financial relationship with a sponsor relevant to the content under discussion, that relationship is disclosed adjacent to the content or in the faculty member’s profile.
Editorial content not designated as sponsored is produced by the PEAK Medicals editorial team and reflects our editorial judgement, not the views of any sponsor. Where the Site reports on clinical data for a sponsor’s product, we cite the primary source (a peer-reviewed publication, a conference presentation, or a regulatory document) so that you can review the underlying evidence directly.
We may use machine-learning and generative-AI tools to support our editorial workflow (for example, to draft summaries of publicly available conference reports, to translate or transcribe video material, or to suggest content tagging). All published content is reviewed and edited by qualified human editors before publication; AI tools are one of several drafting and quality-assurance aids and do not substitute for human editorial judgement.
6. Medical Disclaimer
6.1 For healthcare professionals only
The Intl. Lung Cancer Summit and the Site are intended exclusively for the audience described in Section 2. The content is educational and informational and is not medical advice. If you are a patient or a caregiver, please consult a qualified clinician about your specific situation; do not rely on Site content for treatment decisions. In a medical emergency, call your local emergency number or attend the nearest emergency department immediately.
6.2 Not a substitute for clinical judgement
All clinical content on the Site (articles, video interviews, conference sessions, webinars, symposia, slide decks, downloadable materials, and supporting materials) is provided to support continuing medical education and peer-to-peer discussion among professionals. It is not intended to diagnose, treat, cure, or prevent any disease, and it is not a substitute for the clinical judgement of a qualified medical professional. Healthcare professionals using the Site retain full responsibility for the clinical decisions they make.
6.3 No physician-patient relationship; not the practice of medicine
Nothing on the Site constitutes medical advice and using the Site does not create a physician-patient relationship between you and PEAK Medicals GmbH, its editors, its faculty, its sponsors, or any individual who appears on or contributes to the Site. The Services, including any interactive, messaging, comment, question-and-answer, or peer-exchange features we may offer, do not constitute the practice of medicine, nursing, pharmacy, or any other regulated health profession by PEAK Medicals GmbH or by any individual contributor in connection with the Site.
6.4 Off-label, investigational, and pre-approval content
Lung cancer is a fast-moving therapeutic area. Some content on the Site discusses investigational agents, off-label uses, combinations not yet approved by any regulator, dosing schedules not contained in the approved label, or data from ongoing clinical trials. Such content is presented to keep professionals informed of the scientific evidence base. It does not constitute promotion or endorsement of any product, and it is not a recommendation to prescribe or use any product outside its locally approved indication. The marketing-authorisation status of a drug or device varies by country and may change between publication and the time you view the content. Always check the current local prescribing information from the manufacturer before clinical use.
6.5 Jurisdiction of content
Content on the Site is prepared in Switzerland and is directed to a global audience of Healthcare Professionals. We make no representation that any material on the Site is appropriate, available, lawful, or useful for use in any particular country, territory, or healthcare system. Persons who access the Site do so on their own initiative and are responsible for compliance with applicable local law and professional regulation. Some products discussed may not be authorised, reimbursed, or available in your country.
6.6 Local regulations and prescribing information
Medical practice is regulated by national authorities. A treatment approach acceptable in one country may not be approved, reimbursed, or considered standard of care in another. The Site does not attempt to reflect every local regulatory position. Before applying any information from the Site to a clinical decision, consult the local prescribing information, the relevant national guideline, and your institution’s policies.
6.7 Accuracy and currency of content
We make reasonable efforts to confirm that content is accurate at the time of publication. Lung cancer science evolves rapidly; data presented at a conference may be superseded by a later publication, regulatory decision, or updated guideline within months. Each piece of content is dated; please consider the publication date when assessing the currency of the information. We make no representation that the Site is comprehensive, free of error, or up to date at any later point.
6.8 Adverse-event reporting
The Site is not a pharmacovigilance reporting channel. If you wish to report a suspected adverse drug reaction, product-quality complaint, or other safety event concerning a medicinal product, follow the procedure of your national pharmacovigilance authority (for example, the European Medicines Agency, the United States Food and Drug Administration, Swissmedic, the Medicines and Healthcare products Regulatory Agency, or the equivalent body in your country) and contact the relevant marketing-authorisation holder directly. If you nonetheless report a safety event to us about a product manufactured or marketed by one of our sponsors, you acknowledge that we may be obliged to forward your report and your contact details to that marketing-authorisation holder so that the holder can fulfil its statutory pharmacovigilance obligations; we will tell you at the time of forwarding. See Section 5.6 of our Privacy Policy for the data-protection basis on which this forwarding is carried out.
6.9 Third-party content
The Site links to and references third-party sources, including peer-reviewed journals, conference websites, regulatory authority pages, and sponsor microsites. We do not control and are not responsible for the content of those third-party sources, and a link does not constitute our endorsement of the linked material. Apply your own professional judgement when reviewing third-party information.
6.10 No medical advice; no endorsement
We do not provide medical advice, and we do not recommend or endorse any specific product, therapy, test, physician, healthcare professional, or opinion. Where content describes a product, that description does not imply that the product is suitable, available, approved, or reimbursed in your jurisdiction.
6.11 Reporting an error
If you believe content on the Site is inaccurate, out of date, or potentially harmful, please notify the editorial team at registration@lungsummit.org. We review correction requests promptly.
7. Intellectual property
The Site, the Services, and all underlying software, design elements, text, video, images, and trademarks are protected by Swiss and international intellectual-property law. Except as expressly permitted by law or by these Terms, you must not modify, rent, lease, loan, sell, distribute, broadcast, publicly perform, create derivative works of, or use for any commercial purpose any part of the Site or the Services. Any use not expressly permitted by these Terms is a breach of these Terms and may infringe our or a third party’s intellectual-property rights.
You may view content provided through the Services online, download individual articles for personal review on your own device, and print a copy of an article for your personal professional use. You may not copy in bulk, redistribute, remove copyright notices from our materials, use the content for any commercial purpose, republish the content, or use the content to train any machine-learning or generative-AI model. You may not access the Services other than through the user interface we provide.
Subject to applicable law, any feedback or suggestions you send us are licensed to us on a non-exclusive, perpetual, irrevocable, worldwide, royalty-free basis for any purpose.
8. Privacy and cookies
Our Privacy Policy describes how we collect, use, and protect your personal data. Our Cookie Policy describes the cookies set on the Site and how you can change your consent choices. By using the Services, you acknowledge and agree that both documents form an integral part of these Terms.
9. Third-party content and links
The Services may contain links to third-party websites or resources that are not part of the PEAK Medicals network. We are not responsible or liable for those sites or resources, including their availability or content. The inclusion of a third-party resource on the Site does not imply our endorsement of it. Your dealings with third parties found through the Services (including any pharma sponsor, advertiser, or content partner) are solely between you and that third party. We are not responsible for any loss or damage of any kind arising from those dealings.
10. Disclaimer of warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, BE SECURE, OR BE ERROR-FREE. WE DO NOT WARRANT THE ACCURACY, TIMELINESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICES. NO INFORMATION PROVIDED THROUGH THE SERVICES, WHETHER ORAL OR WRITTEN, SHALL CREATE ANY WARRANTY NOT EXPRESSLY SET FORTH IN THESE TERMS. YOUR RELIANCE ON ANY CONTENT YOU RECEIVE THROUGH THE SERVICES IS AT YOUR OWN RISK. WE DO NOT PROVIDE MEDICAL ADVICE AND WE DO NOT RECOMMEND OR ENDORSE ANY PARTICULAR PRODUCT, THERAPY, TEST, PHYSICIAN, HEALTHCARE PROFESSIONAL, OR OPINION. Nothing in this Section limits any warranty or statutory right that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by Swiss law, PEAK Medicals GmbH, its affiliates, and any other person or entity involved in creating, developing, or delivering the Services shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including but not limited to lost profits, business interruption, loss of data, loss of goodwill, personal injury, or death) arising out of or in connection with these Terms, the Services, or any content, whether based on warranty, contract, tort (including negligence), strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages. Our aggregate liability under or in connection with these Terms, however arising, is limited to the greater of (a) the amount you have paid us for access to the Services in the 12 months preceding the event giving rise to the claim, or (b) one hundred Swiss francs (CHF 100). The remedies under these Terms are exclusive and limited to those expressly set out. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded under mandatory Swiss law, including liability for personal injury or death caused by gross negligence or intentional wrongdoing.
12. Indemnity
You agree to indemnify and hold us, our affiliates, and our officers, directors, employees, agents, licensors, and suppliers harmless from and against any claim, action, or demand, including reasonable legal fees, arising out of or alleged to arise out of your access to or use of the Services, any content you submit, or your breach of these Terms or of any applicable law or professional regulation.
13. Copyright takedown
If you believe material on the Site infringes your copyright, please contact hello@peakmedicals.com with the following:
- Identification of the copyrighted work you believe to be infringed, including a description and where possible the URL of an authorised version
- Identification of the material on the Site that you believe to be infringing, including its URL
- Your name, address, telephone number, and email address
- A statement that the information you have supplied is accurate and that, under penalty of perjury, you are the copyright owner or are authorised to act on the copyright owner’s behalf
We will review the request and remove or restrict access to the material if the claim is substantiated. We reserve the right to forward your notice to the user who provided the material and to publish a redacted copy of the notice for transparency.
14. Suspension and termination
We may suspend or terminate your access to the Services at any time, with or without notice, where you breach these Terms, where required by law, where we discontinue the Services in whole or in part, or where suspension is necessary to protect the integrity of the Services or other users. You may terminate your account at any time through the procedure in our Privacy Policy. Sections concerning intellectual property, disclaimers, liability, indemnity, governing law, and dispute resolution survive termination.
15. Modifications
We may modify these Terms or any of the Services at our reasonable discretion. The current version of these Terms is always available at this URL with the “last updated” date below. Material modifications (changes that affect your rights or obligations) will be notified to registered users by email at least 30 days before they take effect, and you may terminate your account before they apply. Non-material modifications (clarifications, formatting, grammatical corrections) take effect on posting. By continuing to use the Services after a modification takes effect, you agree to be bound by the modified Terms; if the modified Terms are not acceptable to you, please stop using the Services before they take effect.
16. Notices and communication
Any notice we send you under these Terms will be sent by email to the address in your Registration Information; the date of receipt is the date the email is sent. You may contact us at the address in Section 19. You agree to receive electronic communications from us in connection with the Services and that those communications satisfy any legal requirement that such communications be in writing.
17. No waiver, severability, and entire agreement
Our failure to enforce any right or provision of these Terms is not a waiver of future enforcement of that right or provision. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force, and the invalid provision is replaced by a valid provision that most closely reflects the intent of the original. These Terms, together with the Privacy Policy, the Cookie Policy, and the Legal Notice, constitute the entire agreement between you and us regarding the Services and supersede any prior agreement on the same subject.
18. Governing law and jurisdiction
These Terms are governed by the substantive law of Switzerland, to the exclusion of its conflict-of-laws rules and of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for any dispute arising out of or in connection with these Terms is Zurich, Switzerland, subject to any mandatory consumer-protection forum that may be available to you under the law of your country of residence.
